Effective date: October 24, 2026
IMPORTANT: This Arbitration Agreement applies only if you clearly and affirmatively agree to it. Merely browsing the website should not be treated as acceptance. A separate vehicle, lease, financing, or brokerage contract may contain its own dispute-resolution terms; that signed contract governs disputes within its scope.
1. Agreement to arbitrate
If you affirmatively accept this Arbitration Agreement, you and GP Autohaus Inc. agree that covered disputes arising out of or relating to your use of gpautohaus.com or the website brokerage inquiry process will be resolved by final, binding arbitration on an individual basis, rather than in court, except for the claims listed below. The Federal Arbitration Act governs this agreement where applicable; otherwise California law applies.
2. Informal resolution first
Before starting arbitration, the party raising a dispute will send the other party a written notice describing the issue and requested resolution. Notices to GP Autohaus should be sent to its address or email listed in Section 8. The parties will try in good faith to resolve the dispute for at least 30 days after notice. Either party may request a phone or video meeting during that period.
3. Arbitration process
The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, as modified by this agreement and applicable law. If AAA cannot administer the case, the parties will select another established consumer arbitration provider; if they cannot agree, a court may appoint one as permitted by law. The hearing may be held remotely or, if an in-person hearing is required, in the California county where the consumer resides or another location required by law. The arbitrator will be a neutral decision-maker and may award the same individual relief that a court could award under applicable law.
Filing and arbitration fees will be allocated under the provider’s consumer rules and applicable law. Nothing in this agreement requires a consumer to pay fees that applicable law or the provider’s consumer standards require the business to pay. Each party may be represented by counsel at its own expense, subject to any fee-shifting right under applicable law.
4. Exceptions
Either party may bring an eligible individual claim in small claims court. Either party may seek temporary or emergency relief from a court to protect rights while arbitration is pending. Claims that cannot legally be required to arbitration, and requests for public injunctive relief to the extent a court determines they must remain in court, are not covered by this agreement.
5. Individual proceedings
To the extent permitted by law, arbitration will be conducted only on an individual basis. The arbitrator may not consolidate the claims of different people or preside over a class or representative proceeding. This provision does not waive any nonwaivable right or remedy. If a court finds that a particular claim or remedy cannot lawfully be restricted to individual arbitration, that claim or remedy will proceed in court and the remaining arbitrable claims will proceed individually.
6. Opt out
You may opt out of this Arbitration Agreement within 30 days after first accepting it by emailing info@gpautohaus.com with the subject “Arbitration Opt-Out” and your name, address, the website domain, and a clear statement that you opt out. Opting out will not affect other Terms or any separate written transaction contract.
7. Severability and changes
If a provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law, subject to the limits on class or representative arbitration described above. GP Autohaus will not materially change this Arbitration Agreement for a dispute after that dispute has arisen. A revised version applies only as permitted by law and after any required renewed assent.
